Former Bank Analyst Jailed Three Years for Unlicensed Securities Activities
The Kuala Lumpur Sessions Court has sentenced Mohd Arif Fadzlee Mohd Arifin, a former bank analyst, to three years in prison for unlicensed regulated activities and unlawfully using the Unit Trust Consultant title. He was originally charged by the Securities Commission Malaysia on January 23, 2024 with two CMSA offences: posing as a CIMB Wealth Advisors Berhad representative dealing in securities without a CMSRL, and misusing the Unit Trust Consultant title. The offences occurred in 2011 in Petaling Jaya and Nilai. After a trial in which he faced ten witnesses and bail of RM60,000, the court found that the prosecution had proven a prima facie case and he failed to raise a reasonable doubt. The two sentences run concurrently. The case underscores the requirements for licensing to deal in securities in Malaysia and the prohibition on misusing professional titles to imply licensure.
