Clancy Defense Seeks to Block Retrial

Lindsay Clancy’s defense attorney, Kevin Reddington, has filed a motion seeking to prevent a retrial after jurors deadlocked 11-1 and a judge declared a mistrial. Clancy is accused of strangling her three children—Cora, 5, Dawson, 3, and Callan, 8 months—in their Duxbury, Massachusetts, home in January 2023 before attempting suicide, which left her paralyzed. Reddington says juror accounts support the defense’s claim that 11 jurors favored a not-guilty-by-reason-of-insanity verdict, while one juror held out; prosecutors maintained that Clancy’s illness did not prevent her from knowing the killings were wrong. The defense is expected to argue double jeopardy and lack of criminal responsibility at a Sept. 29 hearing, and Reddington has said he remains open to a plea agreement; prosecutors have not decided whether to pursue a new trial.
