Lindsay Clancy lawyer seeks dismissal, claims no evidence of killings
After previously not disputing that Lindsay Clancy killed her children, lawyer Kevin Reddington now argues there is no evidence and seeks to dismiss the case.

A Daily Mail TikTok opens on what its own caption calls a “stunning 180” by Lindsay Clancy’s lawyer. The channel’s description says he originally never disputed that Clancy killed her three children, but now argues there is “no evidence” she did it at all, calls the entire case “speculation,” and is asking the judge to throw the case out instead of allowing a retrial.
The hearing it tracks was held Tuesday, Sept. 29, 2026, at Plymouth County Superior Court. Kevin Reddington argued before Judge William Sullivan on a renewed Rule 25(b)(2) motion for a required finding of not guilty, contending the trial evidence was legally insufficient under the Latimore standard. “Where is the evidence that she did this? Where is the evidence that she did this?” Reddington said, according to CBS Boston’s Kristina Rex. “This entire case is based on speculation. Where is the admission? Where does she say that she did this?”
“There’s no evidence that she admitted she did this,” he added in court. He also questioned the accuracy of Clancy’s hospital statements as “chilling,” CBC News reported, saying she was told what happened. Outside court he told Rex the argument was not new. “Look, I argued that in the trial, I argued it on a motion for a required finding, it’s not new rocket science by any means. It’s the fact that [prosecutors] cannot prove a probable cause.”
The shift collides with the defense’s earlier record. In a June pretrial hearing Reddington said, “She takes responsibility. She, as the kids say, she owns it. She’s not running away from anything here. This whole case is an extreme tragedy.” His April 2026 motion offered a written stipulation that Clancy admits killing her kids and sought to bifurcate guilt from mental state; that request was denied. CBS Boston reported that in his July opening statement he said Clancy “knows what happened to those kids.” On Tuesday he told Sullivan he was splitting the required-finding argument in two parts, consistent with the earlier bifurcation request. “You’re put in a conundrum when you have to admit culpability in order to raise a lack of criminal responsibility,” Reddington said.
Prosecutor Shanan Buckingham answered in court. “Now for the first time the defendant is arguing that there’s no evidence that she did this,” Buckingham said. “I would suggest to you that the entire record is voluminous as to information supporting the fact that she did this.” She pointed to DNA evidence on the exercise bands and testimony from a hospital chaplain that Clancy described hallucinations telling her to kill the children, according to CBC News.
